I still haven't voted... Even after getting a clearer idea of what's going on, I can't place a vote.
If the allegations of breach of contract are really true, Jason and Vince are kinda screwed. Corporations suck and have everyone by the balls, and while I don't support that kind of business operation they aren't doing anything wrong... Legally.
In a perfect world, Activision would have been more open to funding and promoting the ideas and games of its successful developers and maybe this whole crisis would have been avoided.
I don't understand why Activision wouldn't just put shitloads of money into new games, considering how much money they were making and how little (by comparison) they were putting into developement elsewhere... These guys knew what they were doing, why not let them do it? Bah... that's my rant for the day.
Legally think activision will come out on top. Morally, not so much. So I'm on the IW side.
I'd be mad too if it came down to getting paid through legal issues, not only did I have to do that with the company I work for but also a roommate that failed to live up to his end of a deal. I say take them for all they have
I refrain from voting until I know all the facts. No matter how much news comes out about this, it's usually just people sucking west and zampelli's collective dicks, and flinging shit at activision for being a big bad corporation.
It's really hard to come to any conclusions when all the "facts" I get are entirely based on opinions and assumptions.
In my personal 'opinion' Tachion is making the most sense of any comments here, or of anything I've read on the subject so far. If you want a percentage of earnings instead of massive wages, you negotiate that in your contract -before- a game comes out... Usually before you even start, I should think
Personally? I don't care. It's the rich suing the richer. Either way you look at it, it is greed. Regardless of the motivations, that's what it comes down to.
Did Infinity Ward get paid for the work they were commissioned to do? Yes. Did they more than likely sign into a contract that laid out exactly how much they would be paid? I'd be surprised if they didn't. Did their work end up making Activision more money than either party expected? Probably. Should Activision have paid them accordingly? I don't see why not, but that's why I'm not in business.
Maybe if it was actually Infinity Ward vs. Activision, I might care a bit more, but it isn't. It is Jason West and Vince Zampella suing Activision. Since they were fired, they no longer are a part of Infinity Ward. Yes, they founded the company, however, if they win, do you really think that the people that actually worked on the games that made all the money will ever see a cent? Again I say it all comes down to greed.
I'm all for the little guy, but didn't West and Zampella already leave EA for similar reasons? There comes a point in time where you have to realize that you're not as important as you think you are. They should be content with the fact that they are making games at all. My vote goes to Infinity Ward but I have a mutual disliking.
